اللعان لنفي النسب Al Li'an To Deny Filiation

Résumé: اهتمت الشريعة الإسلامية بموضوع النسب من جميع النواحي، وأقرّت إثباته بمجموعة من الوسائل الشرعية، وسمحت في بعض المواضع بنفيه، وحددت في ذلك طريقة مشروعة وحيدة لنفيه وهي اللعان. وعليه تتجلى أهداف دراسة هذا الموضوع في إبراز وتوضيح أهم الأحكام التي وضعتها الشريعة الإسلامية بخصوص اللعان. ومن أهم النتائج المتوصل إليها: أن اللعان ورد في قانون الأسرة الجزائري في موضعين فقط، أحدهما في المادة 41 باعتباره الطريقة المشروعة لنفي النسب، والثانية في المادة 138 باعتباره مانع من موانع الميراث، وأنه يمكن إجراء اللعان حسب الشروط المنصوص عليها في الفقه الإسلامي، ويتم اتباع الأحكام التي خصصتها الشريعة الإسلامية في موضوع اللعان حيس المادة 222 من نفس القانون. Abstract: Filiation subject was well apprehended in Al Sharia in all its aspects for its capital importance in preserving the family. While it can be acknowledged by all the available means, filiation can be denied only with one legitimate way that is Al Li'an. The aim of this study is to highlight and clarify the most important provisions established by Al Sharia. Among the most important results reached: In Algerian Family Code, Al Li'an is mentioned two times: the first was in Article 41 as the legitimate way to deny filiation, and the second in Article 138 as an obstacle to inheritance, without any further details, leaving, thus, referring to Al Sharia, according to the Article 222.
