العملات المشفرة وقانونيتها في فلسطين

Résumé: تعتبر العملات المشفرة أحد إفرازات ثورة المعلومات والإتصالات والتي خلقت تقارب دولي بحيث أضحت عملية الدفع تتم في بيئة الإنترنت، وفي ظل افتقار غالبية التشريعات لتنظيم قانوني خاص بالعملات المشفرة واتجاه غالبية التشريعات لحظرها، أدى ذلك لخلق خلاف فقهي فيما يتعلق بطبيعتها القانونية، وبالرغم من اتجاه سلطة النقد الفلسطينية لحظر التعامل بالعملات المشفرة وظهور العديد من الفتاوي التي جعلت من التعامل بها محرماً، إلا أنها أصبحت واقعاً لا يمكن التهرب منه، الأمر الذي يخلق حاجة لإتخاذ موقف إيجابي من هذه العملات المشفرة وتظيمها في تشريعاتها مستعينة بذلك بتجارب الدول السباقة في ذلك. Cryptocurrencies are considered one of the outcomes of the information and communication revolution, which has created international convergence, making online payments possible. Due to the lack of specific legal regulations regarding cryptocurrencies in most legislations and the tendency of many legislations to ban them, this has led to a legal dispute regarding their nature. Despite the Palestinian Monetary Authority's direction to ban dealing with cryptocurrencies and the issuance of various fatwas declaring them forbidden, they have become an inevitable reality. This creates a need to adopt a positive stance towards cryptocurrencies and regulate them in legislation, drawing on the experiences of pioneering countries in this regard.
