الأليات الوقائية والردعية لمكافحة الفساد في الشريعة الإسلامية و التشريع الجزائري

Résumé: إن الفساد ظاهرة تعد من أهم التحديات التي تواجه المجتمعات، والتي أرهقت ولا زالت ترهق كاهل العديد من الدول مما تسببه من خسائر وآثار تعود بالسلب على المواطن والدولة على حد سواء، وكمحاولة للحد من هذه الظاهرة يأتي هذا البحث للكشف والوقوف على الأليات الوقائية والردعية التي عمدها المشرع الجزائري وما يقابل ذلك في الشريعة الإسلامية حدا لهذه ظاهرة، ولقد توصل البحث إلى ضرورة الاقتداء بأحكام الشريعة الإسلامية ، وإعادة النظر في السياسة الجنائية المطبقة إزاء جرائم الفساد.
