الحماية الجنائية الموضوعية لحق الطفل في الحياة في الجزائر

Résumé: يتناول البحث دراسة الحماية الجزائية لحق الطفل في الحياة في القانون الجزائري ،بكون وصف حق الحياة أسمى حقوق الإنسان وأن الطفل هو إنسان ضعيف لابد من حمايته ضد من يرتكب بحقه فعل يراد به حياته ،وتناولنا الحماية المتعلقة بأحكام خاصة كخطف الأطفال وقتل الطفل وتعريض حياتهم للخطر ،وتوصلنا إلى وجوب تشديد العقوبات إلى أقصى حد ، وزيادة الحماية كما نرجو من المشرع تعريف الطفل"الشخص من لحظة بداية ولادته إلى بلوغه سن الرشد المحدد قانونا". The research deals with the study of the penal protection of the child's right to life in Algerian law, that describing the right to life is the highest human right and that the child is a weak person that must be protected against those against whom he commits an act for which his life is intended. We have concluded that the penalties must be tightened to the maximum extent and protection should be increased. We also ask the legislator to define the child as "a person from the moment of his birth until he reaches the legal age of adulthood."
