مبررات اللجوء إلى التحكيم لتسوية منازعات عقود الاستثمار

Résumé: تعتبر آلية التحكيم أهم وسيلة تلجأ إليها الأطراف المتنازعة في عقود الاستثمار لتسوية نزاعهم، خاصة العقود التي تكون فيها الدولة طرفا، بحيث أن التحكيم يمكن من تحقيق العدالة لصالح الطرفين خاصة المستثمر الذي تكون جنسيته أجنبية، كما أنه يحقق السرعة في الفصل في النزاع نظرا لكفاءة وتخصص المحكمين. وهذه المميزات المتعلقة بالتحكيم السابقة الذكر تعتبر أهم المبررات التي تدفع أطراف النزاع للجوء إليه لتسوية نزاعهم. الكلمات المفتاحية: عقود الاستثمار؛ نزاع؛ تسوية؛ التحكيم. The arbitration mechanism is the most important method used by the disputing parties in investment contracts to settle their dispute, particularly those in which the State is a party, so that arbitration enables justice to be done to the parties, especially the investor of foreign nationality, and achieves speed in the adjudication of the dispute due to the competence and specialization og the arbitrators. These characteristics of the above-mentioned arbitration are the most important justification for the parties to the dispute to resort to it in order to settle their dispute.
