الجمع بين طريقَتَي المتكلّمين والفقهاء في التأليف الأصولي: دراسة تاريخية نقدية

Résumé: يتناول هذا البحث دراسة عن المؤلّفات على الطّريقة الجامعة بين طريقتي المتّكلمين والفقهاء في علم أصول الفقه، ويهدف إلى التّعريف بهذه الطريقة، وبيان تاريخ وسبب ظهورها، وأبرز مؤلّفاتها، وأهم خصائصها ومميزاتها، والمآخذ عليها، والمقارنة بينها وبين طريقة تخريج الفروع على الأصول. وقد توصّل الباحث إلى أنَّ هذه الطّريقة متأخرة عن الطّريقتين السّابقتين، وأكثر المُؤلّفين عليها هم من الحنفية، وتهدف إلى الجمع بين تقرير القواعد الأصولية وإقامة الأدلّة عليها مع تطبيقها على الفروع الفقهية، وهي طريقة جيّدة في التّأليف لولا ما يُعكّرُ عليها من بعض المآخذ والملاحظات، وقد تبيّن من خلال البحث الفرق بينها وبين طريقة تخريج الفروع على الأصول، إذ تُعتبر هذه الأخيرة منبثقةً منها ونتيجة لها. Abstract : This research deals with the methodology of combining the method of the jurists and that of the speakers (Orators) in writing about the discipline of the principles of jurisprudence. It aims at introducing this method, identifying its history and the reason for its emergence, and its major publications, and its most important characteristics and distinctive features, and a comparing between and the method of projecting the branches on principles. This study aims to make this method known and, retrace its history and the reasons of its emergence, and the major writing works about it, its features and advantages, its critics, and the comparison between this and the method of graduating branches on assets.(this translation uses a term from economics) The researcher reached the conclusion so as this method came later than the two previous ones. And the most of its authors are from the Hanafi School (Madhab), and it aims at combining the establishment of the fundamental principal rules and setting evidence for them , and their applications on the jurisprudence branches. It is a good method of writing, in spite of some shortcomings and limitations. This research has revealed the main difference between this method and the method of projecting the branches on principles. The latter is considered as deriving and resulting from it.
