الضمانات القانونية للطفل الجانح في اطار الوساطة الجزائية

Résumé: مـــلــخــص: إن مجمل الجرائم المرتكبة من قبل الأطفال، التي تُعرف بظاهرة جنوح الأحداث، هي الأخرى لاقت اهتماما كبيرا، سواء على الصعيد الدولي أو الوطني، وذلك في إطار البحث عن سبل التقليل والحد منها مع تفعيل مبدأ الحماية القانونية للحدث الجانح، الذي كرسته بكل وضوح، مختلف العهود والمواثيق الدولية لحقوق الإنسان، وما تبعها من الدساتير الوطنية، لمختلف دول العالم الحديث، وصولا إلى تشريعاتها العقابية بشقيها، الموضوعي والإجرائي. تعتبر الوساطة الجزائية، من بين أهم الأحكام المستحدثة، بمقتضى القانون رقم: 15/ 12 المتعلق بحماية الطفل، والتي تهدف في مجملها، إلى الحد من تسليط العقوبة على الحدث الجانح، وفي سبيل ذلك ضَمَّنَهَا المشرع الجزائري، بمجموعة معتبرة من الضمانات القانونية، التي من شأنها أن تشكل مظاهر الحماية القانونية للطفل، سواء كان ذلك في خلال المرحلة التي تُجرى فيها الوساطة، أو بعد انتهائها، وما يترتب عن ذلك من آثار الحماية القانونية الفعلية. Abstract The total crimes committed by children , known as juvenile delinquency, have also raceived great attention both internationally and nationally.this is in search of ways to reduce and limit them, namely, activating the principle of legal protection for juvenill delinquent international convants and charters of human right, and the subsequent national constitution of the various countries of the modern world, reaching to their penal legislation both objectively and procedurally. Criminal mediation is one of the most important provision of the law, which is enacted under law no.15-12 on the protection of children, which aimes at reducing the punishment of juvenile delinquent and for that purpose the algerian legislator, with a significant set of legal regulation that would constitute legal protection for the child either whether during the period in which the mediation takes place or after its end the consequent effect are to be the effective protection.
