دور السلطة الوطنية المستقلة للانتخابات كمؤسسة رقابية (دراسة على ضوء أحكام الأمر رقم 21-01 المتضمن القانون العضوي المتعلق بنظام الانتخابات)

Résumé: تعد السلطة الوطنية المستقلة للانتخابات آلية رقابية جديدة، استحدثها المشرع الجزائري بموجب صدور القانون العضوي رقم 19-07، لتحل بذلك محل الهيئة الوطنية المستقلة لمراقبة الانتخابات التي كانت معروفة في ظل القانون العضوي رقم 16-11. أقدم المؤسس الجزائري على دسترة السلطة الوطنية المستقلة للانتخابات لأول مرة في التجربة الدستورية الجزائرية بمناسبة التعديل الدستوري لسنة 2020. وتطبيقا لأحكام المادة 201 من هذا التعديل الدستوري، صدر الأمر رقم 21-01 المتضمن القانون العضوي المتعلق بنظام الانتخابات، والذي كرس مجددا السلطة الوطنية المستقلة للانتخابات كمؤسسة رقابية، خول لها صلاحيات واسعة في مجال تنظيم سائر العمليات الانتخابية والاستفتائية والإشراف عليها عبر جميع مراحلها، منذ استدعاء الهيئة الناخبة إلى غاية الإعلان عن النتائج المؤقتة، بغرض ضمان نزاهتها الكلمات المفتاحية: الدستور، العمليات الانتخابية والاستفتائية، السلطة الوطنية المستقلة للانتخابات، الرقابة والإشراف، الاستقلالية، النزاهة والحياد. ABSTRACT The Independent National Electoral Authority is a new mechanism developed by the Algerian legislator pursuant to the issuance of organic law no 19-07, to replace the Independent National Election Monitoring Authority, which was known under organic law no 16-11. The penal Founder has constitutionalized the Independent National Electoral Authority for the first time in the penal constitutional experiment on the occasion of the constitutional amendment of 2020. In implementation of the provisions of article 201 of the constitutional amendment of 2020, decree no 21-01 was issued containing the organic law related to the electoral system, in which the legislator once again dedicated the independent national authority as an oversight institution, conferring upon it many and wide powers in the field of organizing electoral and referendum processes throughout all their stages from time of summoning the electoral college until the announcement of the provisional results, in order to ensure its integrity and transparency.
