حقيقة مراعاة الخلاف عند المالكية وأثرها في الفقه المالكي.

Résumé: نهدف من خلال دراستنا إلى مدى اعتبار قاعدة مراعاة الخلاف عند المالكية وتأثيرها على الأحكام الفقهية والنوازل، مبينا فيها حقيقتها عند علماء المالكية، والفروق بينها وبين بعض القواعد التي اشتبهت بها، كقاعدة الخروج على الخلاف وغيرها، ثم الحديث عن حجيتها في المذهب باعتبار الخلاف الوارد في المذهب المالكي مبينا في الأخير القول الراجح فيها، مع ذكر بعض الأمثلة We aim through our study to consider the extent to which the rule of taking into account the disagreement among the Malikis and its impact on jurisprudential rulings and calamities, showing in it its reality according to the Maliki scholars, and the differences between it and some of the rules that were suspected of it, as the rule of leaving the dispute and others, and then talking about its authoritativeness in the doctrine considering the disagreement contained in In the end, the Maliki school clarifies the most correct view, with some examples.
