العقوبة في النظام القانوني للمحكمة الجنائية الدولية

Résumé: ملخص: ان مسألة تحديد العقوبات للجرائم الدولية شغلت بال الكثيرين من الباحثين بسبب غموض وعدم دقة وتحديد العقوبات المناسبة للجرائم الدولية، وترك تلك المسألة للقاضي الوطني او الدولي، لان العرف الدولي لم يهتم بتوضيح هذه المسألة، وعلى الرغم من تقنين الاحكام العرفية المتعلقة باركان الجرائم الدولية في اطار الانظمة الاساسة للمحاكم الدولية الجنائية بكافة انواعها: الدائمة، المؤقتة، المختلطة، وكذلك تحديد العقوبات المناسبة لها، الا ان هذه الجهود ظلت مقتصرة على الجرائم الدولية الاشد خطورة، مثل: جريمة الابادة الجماعية، الجرائم ضد الانسانية، جرائم الحرب، وجريمة العدوان. وهذه الدراسة تهتم ببحث مدى توفيق واضعوا النظام الاساسي للمحكمة الجنائية الدولية في تحديد العقوبات للجرائم الداخلة في اختصاصها، من حيث طبيعة العقوبات الواردة فيها وانواعها وكيفية فرضها وكذلك تخفيضها، مع الاشارة الى النتائج والمقترحات التي ينتهي اليها الدراسة. كلمات مفتاحية: العقوبة. الجرائم الدولية. النظام الاساسي. المحكمة الجنائية الدولية. العرف الدولي.
