المحاكم الجنائية الدولية المؤقتة والعدالة الجنائية الدولية

Résumé: يرتبط تحقيق العدالة الجنائية الدولية بإنشاء المحاكم الجنائية الدولية، هذه الأخير التي قامت على أسس ومبادئ أقرت في مجملها ترسيخا لهذا المبدأ، الذي يعتبر واحدا من أهم المبادئ القارة في القانون الدولي. ونهدف من خلال هذا المقال إلى إبراز دور المحاكم الجنائية الدولية المؤقتة والتي سنحصرها في كل من المحكمة الجنائية الدولية ليوغسلافيا السابقة والمحكمة الجنائية الدولية لروندا في إقرار مبدأ العدالة الجنائية الدولية، من خلال التطرق للاختصاص الموضوعي لها، وإقرارها للمسؤولية الجنائية الدولية الفردية، وتطرقها لمبدأ التكامل. The achievement of international criminal justice is linked to the establishment of the International Criminal Courts, of which the latter relied on foundations and principles which have been approved in their entirety to establish this principle, which is considered to be one of the most important principles of international law. Through this article, we aim to highlight the role of temporary international criminal tribunals, which we will limit to the International Criminal Tribunal for the former Yugoslavia and the International Criminal Tribunal for Rwanda in establishing the principle of criminal justice international
