مفارقات وقف التنفيذ لمذكرتي الإعتقال الجنائية ضد نتانياهو وغالانت

Résumé: في إطار الجرائم الدولية الإسرائيلية المرتكبة في قطاع غزة, جراء الحرب العدوانية المعلنة على القطاع منذ العام الماضي(2023), قرر القضاء الجنائي الدولي التحرك بخصوص هذه الجرائم الخطيرة, وذلك بإصدار المحكمة الجنائية الدولية أول مذكرتي اعتقال ضد رئيس الوزراء الإسرائيلي بن يامين نتانياهو ووزير الدفاع السابق يواف غالانت, لكونهما مسؤولين مسؤولية جنائية بحكم موقعيهما كمسؤوليين وإشرافهما إشرافا مباشرا, من خلال توجيه الأوامر لارتكاب هذه الجرائم الخطيرة في قطاع غزة(جرائم حرب؛ جرائم ضد الإنسانية...الخ), وعليه يهدف هذا البحث إلى إلقاء الضوء على هاتين المذكرتين من خلال البحث في الأسباب وعوائق التنفيذ, ومن ابرز النتائج المستخلصة ضمن هذا البحث هي وضوح مصدر التفاوت ما بين النصوص القانونية ضمن ميثاق روما, والتي تؤسس إدانة صريحة للقادة الاسرائليين والجنود الضالعين في الجرائم الدولية الخطيرة المرتكبة في غزة بصفة عامة وفي فلسطين بصفة عامة, وبين الحصيلة العملية المتدنية لعمل المحكمة الجنائية الدولية, إلى جانب هشاشة فعالية التنفيذ والالتزام الدولي لقرارات المحكمة من طرف الدول الأطراف. As part of Israel's international crimes committed in the Gaza Strip, as a result of the war of aggression declared against the Gaza Strip since last year (2023), By issuing the first two arrest warrants against Israeli Prime Minister Ben Yamin Netanyahu and former Defence Minister Yaffe Gallant, the international criminal justice court decided to act on these serious crimes. Being criminally liable by virtue of their positions as officials and their direct supervision, by ordering the commission of such serious crimes in the Gaza Strip (war crimes; Crimes against humanity... etc.), and therefore this research aims to shed light on these notes by looking at the causes and impediments to implementation, One of the most important findings of this research is the clarity of the source of the discrepancy between the legal texts of the Rome Charter. which establish an unequivocal condemnation of Israeli leaders and soldiers involved in serious international crimes committed in Gaza in general and in Palestine in general. The low practical outcome of the work of the International Criminal Court, coupled with the fragility of the effective implementation of the Court's decisions and the international commitment of States parties.
