حماية مبدأ المنافسة من التعسف في استغلال وضعية الهيمنة على السوق -دراسة تحليلية في التشريع الجزائري على ضوء نظيره الفرنسي-

Résumé: حاول المشرع الجزائري حماية مبدأ المنافسة باعتباره الآلية الأساسية لدفع المؤسسات إلى تقديم الأفضل وحماية حقوق المستهلك، وقد تجسدت هذه الحماية من خلال حماية العون الاقتصادي باعتباره فاعلا أساسيا في السوق من جميع مظاهر الممارسات التجارية التي تحول دون تفعيل ديناميكية السوق. التعسف في استغلال وضعية الهيمنة إحدى الممارسات المنافية للممارسة التي حظرها المشرع الجزائري. وتهدف هذه الدراسة إلى التعرف على القواعد القانونية الخاصة بهذه الممارسة الواردة في التشريع الجزائري مع الاستئناس بالتجربة الفرنسية في هذا الشأن. The Algerian legislator tried to protect the principle of competition as the basic mechanism for encouraging institutions to provide the best and protect the rights of consumers. This protection was embodied by protecting economic aid as a key player in the market from all aspects of commercial practices that prevent the activation of market dynamics. Abuse of the status of hegemony is an anti-practice practice banned by the Algerian legislator. The aim of this study is to identify the legal rules of this practice contained in the Algerian legislation and to draw attention to the French experience in this regard
