جواز التلقيح ضد فيروس كورونا وإشكالية صون الحقوق والحريات

Résumé: يطرح تنظيم ممارسة الحرية والذي يأتي بعد الاعتراف بها سواء من طرف السلطة التشريعية أو التنفيذية، إشكالات تثور حول الكيفية التي يتم بواسطتها تحقيق التوازن بين التأطير القانوني لممارسة الحرية ومتطلبات المحافظة على النظام العام بعناصره المختلفة ومنها الصحة العامة. إذا كانت ممارسة الحقوق والحريات في الظروف العادية تتم في إطار تقيد السلطات الضبطية بمبادئ المشروعية والملاءمة فإن هذه القيود تضيق في الظروف الاستثنائية، إذ يسيطر هاجس المحافظة على النظام العام على الممارسة الحرة للحقوق والحريات، وهو الوضع الذي شهدته الجزائر نتيجة الانتشار الكبير لفيروس كورونا، حيث استتبع ذلك اتخاذ مجموعة تدابير قيدت من حقوق وحريات المواطنين، من هذه التدابير استحداث جواز تلقيح يترتب على عدم امتلاكه تقييد ممارسة عدد من الحقوق والحريات. The regulation of the exercise of freedom, which comes after its recognition, whether by the legislative or executive authority, raises problems that arise about how to achieve a balance between the legal framework for the exercise of freedom and the requirements of maintaining public order with its various elements, including public health. If the exercise of rights and freedoms in normal circumstances takes place within the framework of the police authorities’ adherence to the principles of legality and propriety, then these restrictions are narrowed in exceptional circumstances, as the obsession with maintaining public order dominates over the free exercise of rights and freedoms, a situation that Algeria witnessed as a result of the great spread of the Corona virus, where This entailed taking a set of measures that restricted the rights and freedoms of citizens. Among these measures is the introduction of a vaccination pass that, if not possessed, restricts the exercise of a number of rights and freedoms.
