نطاق المسؤولية الإدارية بدون خطأ في مجال العمران.

Résumé: نتناول ضمن هذه الدراسة المسؤولية الإدارية بدون خطأ في مجال العمران، والتي تعد من أدق موضوعات القانون الاداري، التي باتت تلعب دورا بارزا في تحقيق التوازن في علاقة الإدارة بالفرد. وذلك بتسليط الضوء على مدى اسهام القضاء الإداري في إقرار هذا النوع من المسؤولية في الشق العمراني. سواء في ظل تطبيقها المؤسس على نظرية المخاطر، أو التطبيق المتبنى على أساس مبدأ المساواة أمام الأعباء العامة. توصلنا إلى أنه رغم بعض التطبيقات القضائية التي تبنت المسؤولية الادارية بدون خطأ في مجال العمران، وكذا بعض النصوص القانونية التي أشارت إليها في صلب أحكامها، إلا أن مسؤولية الإدارة بدون خطأ في الشق العمراني تظل محدودة ويكتفها القصور في الجزائر سواء من حيث التشريع أو القضاء نتيجة عدة اعتبارات.
