إصلاح أزمة الشرعية الدولية في سياق رقابة محكمة العدل الدولية على قرارات مجلس الأمن الدولي

Résumé: إن أزمة الشرعية الدولية لقرارات مجلس الأمن الدولي التي تشكل جزء من أزمة القانون الدولي، أعادت إحياء فكرة إرساء رقابة قضائية على المجـــلس عن طــريق إصـــلاح جوهـــري لمنظومة الأمم المتحدة في ميدان السلم والأمن الدوليين. والواضـــح أن الهدف من هذه الرقابة المنعـــدمة حالـــيا، هو ممـــارسة سلـــطة المراجعة والفحص من طرف محكمة العـــدل الدولية على كل قرار غيـــر شرعي صادر عن المجلس اقتداء بالنظام الإجرائي القضـــائي الوطني. والظـاهر أن الرقابة الضرورية، صعبة للغاية لأسباب منطقية، تتعلق أولا، بكـون المحكـــمة غير مؤهلة للفصل في منازعة من هذا الشكـل، وغيــــاب أي نص قانوني صريـح يمنح هذا الاختصاص للمحكـمة، علاوة عن صعوبة تعديل ميثاق الأمم المتحــــدة والنظام الأساسي للمحكمة، وتمتع مجلس الأمن بسلطة تقديرية واسعة في إصدار القرارات طبقا للفصل السابع. The crisis of the international lawfulness of the acts of Security Council, which is part of the crisis of public international law, has revived an idea to establish a judicial control on the council by undertaking a process of substantial reform of the nation united in term of international security. It is evident, that the aim of this non-existent control is to exercise the power of revision and verification by the international court of justice over any invalid act emanating by the council in limitation of a national judicial procedural system. It seems that this control which, is necessary is extremely difficult for logical considerations, first the court was not designed to settle a dispute of this kind and the absence of a tacit or implicit textual basis givers the court jurisdiction and the amendment of the United Nations charter and the statute of the court is very painful at the moment, and finally, the enjoyment of security council advice by an unlimited discretionary power in the promulgation of the resolutions in accordance with the seventh chapter of the charter.
