الحماية المدنية للملك الوقفي في التشريع الجزائري

Résumé: كرس المشرع الجزائري جملة من المبادئ تشكل مجموعة من الآليات القانونية التي تهدف لحماية الأملاك الوقفية نظرا لأهميتها البالغة،فبمجرد أن ينشأ العقد صحيحا ،فإنه يترتب عليه مجموعة من الآثار الهامة التي تغير حقيقته وغايته المقصودة منه ،كما تؤكد وجوده وتضمن له البقاء والاستمرار ،و ذلك بالاعتراف له بالشخصية المعنوية بالتبعية لسقوط ملكية المال الموقوف عن ملك الواقف كما تجعله مستقلا عن مستحقيه،وينقطع حق الواقف والموقوف عليه في رقبة العين الموقوفة،فلا يمكن لأي منهم أن يتصرف في الملك الوقفي بنقضه أو يخل بمقصوده،لهذا وجب إخضاعه إلى حماية خاصة تضمن حصانته.
