موقف التشريع الجزائري من التأمين التكافلي دراسة مقارنة بالتجربة المغربية.

Résumé: الملخص بالعربية في الوقت الذي فتحت فيه الكثير من الدول العربية والإسلامية ـ على غرار المغرب ـ المجال أمام التأمين التكافلي كبديلٍ شرعيٍ عن التأمين التقليدي، وذلك من خلال التأسيس القانوني والتشريعي لهذا النوع من التأمين بما يتوافق واجتهادات الفقهاء المعاصرين، لازال التشريع الجزائري يتخذ موقفاً ضبابياً من هذا التأمين. موقفٌ ضبابيٌ يمكن الوقوف عليه من خلال موافقة التشريع الجزائري في تنظيمه لما يُسمى بالتأمين التعاضدي لبعض الأسس الشرعية التي يقوم عليها التأمين التكافلي تارةً، ومخالفتها تارةً أخرى، ما يدفعنا إلى القول بأنه لا يمكن الجزم بالقول أن المشرع الجزائري يعترف بالتأمين التكافلي، وإنما يمكن القول إن هناك أرضية يمكن الانطلاق منها للتأسيس لهذا النوع من التأمين.
