حماية المستهلك في مرحلة تنفيذ العقد وفقاللتشريع الجزائري

Résumé: نظرا للمخاطر الكبيرة التي يمكن أن تلحق المستهلك الجزائري من وراء تعاقداته الاستهلاكية التي يقوم بها بهدف إشباع حاجياته الخاصة وحاجيات بيته من سلع وخدمات، إلا أن نزعته الاستهلاكية جعلته يقع ضحية تعاقداته وضحية المنتوجات التي قام باقتنائها، الأمر الذي دفع بالمشرعالجزائري فيالبداية إلى فرض مجموعة من الضمانات التي أوردها من خلال القواعد العامة في القانون المدني الجزائري، والتي تتمثل في ضمان العيب الخفي وضمان عدم التعرض والاستحقاق إلا أنها عرفت قصورا كبيرا من حيث تحقيق حماية المستهلك، لذا لجأ المشرع إلى تكريس مجموعة من الضمانات الأخرى من خلال القواعد الخاصة المتمثلة في القانون 09 ــ 03 المتعلق بحماية المستهلك وقمع الغش الملغي للقانون 89 ــ 02، وتتمثل هذه الضمانات في ضمان سلامة المستهلك وضمان مطابقة المنتوج للمواصفات، وكذلك إقرار حق المستهلك في العدول وضمان خدمة ما بعد البيع، ولقد حققت هذه الضمانات حماية كبيرة للمستهلك إلا أنها بقيت ناقصة ومفتقرة لبعض النصوص القانونية التي تنظم بعض الجزئيات التي تخص هذه الضمانات، لذلك نحن ندعو المشرع إلى ملء هذا النقص من أجل تحقيق حماية تكون فعالة أكثر للمستهلك.Due to the significant risks that Algerian consumers may face in their consumption contracts aimed at satisfying their personal and household needs for goods and services, their consumeristic tendencies have made them victims of their own contracts and the products they have purchased. This prompted the Algerian legislature initially to impose a set of guarantees outlined in the general principles of Algerian civil law. These guarantees include hidden defect guarantees, non-exposure guarantees, and entitlement guarantees. However, these guarantees have proven to be inadequate in terms of protecting consumers. Consequently, the legislature resorted to enacting additional guarantees through special regulations, namely Law 09-03 concerning consumer protection and the suppression of fraud, repealing Law 89-02. These guarantees involve ensuring consumer safety, product compliance with specifications, granting consumers the right to rescind contracts, and guaranteeing after-sales service. While these guarantees have provided significant consumer protection, they still lack certain legal provisions that regulate specific aspects related to these guarantees. Therefore, we urge the legislature to fill these gaps in order to achieve more effective consumer protection.
