عدم فعالية المحكمة الجنائية الدولية في معاقبة مرتكبي الجرائم التي تدخل في اختصاصها

Résumé: بمقتضى المادة الخامسة 5 من نظام روما الأساسي تختص المحكمة الجنائية الدولية بمحاكمة مرتكبي الجرائم الدولية سواء على أقاليم الدول الأعضاء أو على رعاياها إضافة إلى إمكانية إختصاصها بموافقة الدول الأعضاء أو بإحالة من مجلس الأمن الدولي للنظر في الجرائم التي تمس وتهدد الأمن والسلم الدولي إلا أن فعالية هذا الإختصاص تعترضها عقبات عدة، منها ما هي مرتبطة بالطبيعة القانونية لهذا الإختصاص من خلال تضيق سلطاتها ونطاق إختصاصها، وكذا صعوبة تنفيذ أحكام المحكمة وأوامرها ومنها ما هي خارجية عن إختصاص المحكمة الجنائية الدولية من خلال محدودية العلاقة بين إختصاص المحكمة ومبدأ سيادة الدول. The International Criminal Court according to the Article 5 of the Rome statute, its competent to prosecute the internationals criminals, whether on the territoires of member states or against their nationals, In addition, it may be competent by the approve of non-member States, or by the refer to the Securitiy Concil in the case of crimes that threat the international peace and securitiy However, the effectiveness of this jurisdiction is hampered by several obstacles, including those associated with the legal nature of this jurisdiction through the narrowing of its powers and the scope of its juridiction, as well as the difficulty in enforcing the Court’s orders and rulings, including those outside the jurisdiction of the International Criminel Court through the limited ralationship between the jurisdiction of the Court and the principale of State sovereingnty
