حماية المصنَفات الرقمية في ظل اتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية - تربس-

Résumé: اهتمت هذه الدراسة بتسليط الضوء على حماية للمصنفات الرقمية في اطار اتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية والمعروفة ب تربس حيث تطرقنا في مقالنا هذا الى مفهوم المصنَفات الرقمية وذالك من خلال تبيين أهم خصائصها و أنواعها هذا من جهة أما من جهة ثانية تحديد نظام حماية المصنَفات الرقمية في ظل اتفاقية تربس التى تعتبر احد أهم الاتفاقيات الحامية لحقوق المكية الفكرية و خاصة الرقمية منها، حيث قامت بتحديد للعديد من وسائل و اجراءات لحماية قانونية موضوعية و شكلية تمثلت في حماية مدنية أي دعوى المنافسة غير المشروعة وحماية جزائية متمثلة في دعوى التقليد و جريمة القرصنة ، كل هذا جعلها تتميز وتنفرد عن الاتفاقيات الأخرى إذ تمثل بالفعل ما يمكن أن نطلق عليه بالقانون الدولي لحماية حقوق الملكية الفكرية أكثر من كونها اتفاقية دولية . This study focused on shedding light on the protection of digital works within the framework of the Agreement on Trade-Related Aspects of Intellectual Property Rights known as TRIPS. In this article, we touched on the concept of digital works by showing their most important characteristics and types, on the one hand, on the other hand, defining the system for protecting works Digital in light of the TRIPS which is considered one of the most important agreements protecting intellectual property rights, especially digital ones, as it has identified many means and procedures for objective and formal legal protection represented in civil protection, i.e. the lawsuit of unfair competition and penal protection represented in the counterfeiting lawsuit and the crime of piracy ، All this made it distinguished and unique from other conventions.
