المنازعات الناشئة عن تأسيس السجل العقاري في التشريع الجزائري

Résumé: تخضع المنازعات الناشئة عن تأسيس السجل العقاري، كغيرها من المنازعات إلى مبدأ أن كل منازعة يحكمها نوعان من القواعد، قواعد موضوعية و أخرى إجرائية، حيث وضع كل من الأمر 75/74 المؤرخ في 12/11/1975 المتضمن إعداد مسح الأراضي العام و تأسيس السجل العقاري وما صاحبه من مراسيم تنفيذية من أجل حماية الحقوق العينية للأشخاص من كل اعتداء ، جراء عمليتا مسح الأراضي و تأسيس السجل العقاري، هذه العملية التي ترتبط ارتباطا وثيقا بالنظام المعتنق في الجزائر وهو نظام الشهر العيني . غير أن المسألة وإن كانت تبدو بسيطة للوهلة الأولى، إلا أن عدم وضوح النصوص القانونية تارة وغيابها تارة أخرى،خلق عدة إشكالات قانونية كشف عنها الواقع العملي، و تضاربت بشأنها الآراء و لم يستطع مرفق القضاء وضع اجتهادات قضائية من شأنها أن تسد الفراغ التشريعي. Disputes arising from the establishment of the Land Registry, like other disputes, are subject to the principle that each dispute is governed by two types of rules, objective and procedural rules, in order to protect the in-kind rights of persons from each attack, as a result of the processes of surveying the land and establishing the land registry, this process, which is closely related to the system adopted in Algeria, which is the system of the month in kind. However, although the issue seems simple at first glance, the lack of clarity of the legal texts at other times and their absence at other times created several legal problems revealed by the practical reality, and conflicted opinions and the judicial facility was unable to draw up jurisprudence that would fill the legislative vacuum.
