شروط الإفتاء في النوازل المعاصرة

Résumé: لقد تناول علماؤنا الأوائل بالدراسة موضوع شروط ومواصفات المفتي في كتبهم الأصولية، وتحدثوا عن ما وجب اشتراطه على المفتي في النوازل، وما يكون تحصيله من باب السعي إلى الكمال والتمام في الاجتهاد، ولم يختلف العلماء في اشتراط ما لا يقوم الاجتهاد إلا به ابتداء؛ وإنما وقع الخلاف في جزئيات وتفاصيل الشروط المتفق عليها، واختلفوا كذلك في اشتراط بعض العناصر المكملة للاجتهاد فالبعض اشترطها والآخر لم يلزم اشتراطها، وبالتالي فإن هذه الدراسة تسعى إلى بيان تلك الشروط عند الأصوليين القدامى، وسرد ما وقع بينهم من خلاف، وكذا التعرض إلى الأدلة والمستندات التي اعتمدوها في بناء كل رأي، بعدها نقوم باختيار ما يتلاءم من الأقوال المختلف فيها مع المجتهد المعاصر بما في عصر هذا الأخير من مستجدات ومعطيات حادثة. Our first scientists have studied the subject of the condition of "Mufti" in their books Rules extract Fiqh, they talked about what should be required on the mufti in the new issues, and what will be gained for the pursuit of perfection and completeness in "Ifta" .
