سلطات ربان السفينة في التشريع الجزائري

Résumé: لمّا كان ربان السفينة يعدّ وحده قائدها وسيد الرحلة البحرية، فإن ذلك يقتضي الاعتراف له بسلطات واسعة يمارسها على ظهر السفينة، وهي تنقسم إلى سلطات عامة وأخرى خاصة. فيمارس الربان سلطات عامة بصفته ممثلا للدولة، وتتمثل في سلطة التوثيق لِما يضطلع به من تسجيل بيانات الحالة المدنية للأشخاص كالولادة والوفاة أو ما يحصل بينهم من تصرفات قانونية، كما يُناط بالربان سلطة حفظ الأمن والنظام على متن السفينة، كما له يباشر إجراءات التحقيق والتحري في الجرائم التي يمكن أن ترتكب هناك، بل له حتى أن يمارس سلطة التأديب وتوقيع العقاب على المخالفين الذين يوجدون على ظهر السفينة خلال الرحلة البحرية، كما يباشر الربان اختصاصات خاصة بصفته ممثلا للمجهز وهي إمّا اختصاصات فنية ترتكز على قيادة السفينة وفقا لما تقضيه سلامة الرحلة البحرية دون ضرورة الخضوع لتعليمات المجهز، وإمّا تخصصات تجارية تتمثل في التصرفات القانونية اللازمة التي يتولاها الربان بصفته ممثلا قانونيا أو اتفاقيا للمجهز، كما أن للربان سلطة تمثيل المجهز أمام القضاء متى تعلق النزاع بالسفينة خلال الرحلة البحرية. وإنّ هذه السلطات الهامة والاستثنائية التي يتمتع بها الربان جعلته يحظ بمركز قانوني خاص بين رجال البحر. Since the ship's captain is the sole commander and master of the cruise, it requires recognition of his extensive powers on board vessel, which are divided into public and private powers. The ship’s captain exercises public powers in his capacity as a representative of the State, namely, the authority to certify the registration of persons' civil status data, such as birth and death or legal acts. Ship’s captainis also empowered to maintain security and order on board the vessel and to initiate investigation procedures into crimes that may be committed there, even exercising the authority to discipline and punish offenders on board during a cruise. The ship’s captain also carries out special competencies in his capacity as a representative of the ship-owner, which are either technical competencies based on the ship’s command in accordance with the safety of the cruise without the need to submit to the ship-owner’s instructions, or commercial specializations consisting of the necessary legal conduct of the ship’s captain in his capacity as the legal or agreement representative of the ship-owner. The ship’s captain also has the power to represent the ship-owner before the court when the conflict concerns the ship during the cruise. These important and exceptional powers of the ship’s captain have made him enjoy special legal status among the seamen.
