التوقيع الالكتروني بين حتمية النص و محدودية التطبيق

Résumé: تطور التجارة الإلكترونية فرض ضرورة الإنتقال من الشكل التقليدي الملموس إلى عالم إلكتروني إفتراضي يقوم على تكريس مصطلحات تتماشى ومتطلبات الإقتصاد الرقمي الجديد، إضافة إلى ظهور أنماط جديدة في التعامل الإلكتروني تتطلب حتمية خلق بيئة قانونية مواكبة لهذه المعطيات التقنية في مجال المعاملات الإلكترونية ، خاصة مع بروز مشكلات إثبات المعاملات الإلكترونية التى تتم عبر شبكات الأنترنت ،مما دفع بالمختصين في هذا المجال بالتوازي مع رجال القانون للبحث عن وسيلة تلائم هذا التطور ، ونتج عن ذلك ظهور التوقيع الإلكتروني كأهم وسيلة للإثبات في العصر الحالي في البيئة الرقمية ،وتم إدراج التوقيع الإلكتروني محل التوقيع التقليدي تماشيا مع طبيعة التصرفات القانونية التي لا تكون منتجة لأثارها و لا نافذة الا بإستعمال الوسائل التقنية الحديثة وبالمقابل كفل للتوقيع الإلكتروني حماية قانونية جزائية و تقنية ضمانا لمصلحة المتعاملين في البيئة الإلكترونية التي تحيد عن القواعد القانونية للإثبات المتعارف عليها و السارية المفعول في التعاملات العادية بين الأفراد و التي لا تكتسي صبغة إلكترونية . The development of electronic commerce and the transition from the traditional concrete to a virtual electronic world based on the dedication of terms in line with the new digital economy and new patterns in electronic dealing imposed the imperative of the inclusion of a legal environment in keeping with these technical data in the field of electronic transactions, as a result of the emergence of problems of proving electronic transactions that are carried out through the internet, which prompted specialists in the field of electronic media in parallel with the law men to search for a means to suit this development, and resulted in the emergence of electronic signature as an important means of proof in The current era in the digital environment, and the inclusion of electronic signature in accordance with the nature of legal actions that are not productive for its effects and does not apply except using modern technical means and guarantee discoloration of electronic signature criminal and technical protection to ensure the interest of customers in the electronic environment, which deviates from the legal rules of proof accepted and applicable in normal dealings between individuals and which do not have an electronic nature.
