التحقيق البرلماني أداة لممارسة الرقابة على أعمال السلطة التنفيذية

Résumé: نصت الدساتير الجزائرية المتعاقبة على حق أعضاء البرلمان في إنشاء لجان تحقيق في نطاق الاختصاص الرقابي للبرلمان ، وفي هذا الإطار أكد الدستور الجزائري المعدل في سنة 2020على أنه " يمكن لكل غرفة من البرلمان في إطار اختصاصاتها، أن تنشئ في أي وقت لجان تحقيق في قضايا ذات مصلحة عامة." غير أن تفعيل الوظيفة الرقابية للبرلمان لا يتوقف عند النص على الآلية الرقابية دستوريا، و إنما يمتد إلى أثر هذه الأداة على تحريك مسؤولية الحكومة و محاسبة أعضائها على ضلوعهم في كل قضية محل تحقيق تتعلق بالمصلحة العامة. و تأتي هذه الورقة للنظر في مدى تدارك الدستور الجزائري_ الذي ثار الجدل عميقا بشأن مواكبته لمسار الإصلاح السياسي في الجزائر_ للضعف الذي عانت منه لجان التحقيق في مواجهة الحكومة، و مدى استجابته لمتطلبات الجزائر الجديدة المبنية على قيم الشفافية و سيادة القانون فوق الجميع. Abstract: Successive Algerian constitutions stipulate that members of parliament have the right to establish commissions of inquiry within the scope of the parliamentary jurisdiction. In this context, the revised Algerian constitution of 2020 affirmed that "every chamber of parliament within its jurisdiction can at any time establish committees of inquiry to investigate issues of public interest ". However, the activation of the supervisory function of the parliament does not depend just on mentioning this mechanism in the provision of the constitution, but extends to the efficiency of this mechanism to hold members of the government accountable for their involvement in issues under investigation concerning the public interest. This research paper tries to determine to which extent the Algerian constitution, which has been deeply controversial, has redressed the weakness concerning the commissions of inquiry to control the acts of the government, as a response to the aspiration of the new Algeria based on the values of transparency and the rule of law.
