مقومات انشاء سوق للاوراق المالية الاسلامية - دراسة حالة التجربة الماليزية -

Résumé: تحتل السوق المالية الإسلامية مكانة هامة و مميزة في النظم الاقتصادية المعاصرة، حيث تبين أن أولى الخطوات وأهمها لإنشاء سوق مالية إسلامية تكمن في مدى توفر ووجود الأدوات المالية الإسلامية التي تنضبط بالضوابط الشرعية إصدارا وتداولا.ولذلك فقد جاءت هذه الدراسة لتبين دور وأهمية الأدوات المالية الإسلامية وخاصة منها الأسهم المتوافقة وأحكام الشريعة الإسلامية والصكوك الإسلامية وصناديق الاستثمار الإسلامية في تنشيط وتطوير السوق المالية الإسلامية، حيث توضح أن نجاح هذه السوق وتطورها يعتمد على مدى تنوع وتطور الأدوات المالية الإسلامية المتداولة فيها، حيث أن إتاحة أكثر من بديل أمام المستثمرين يضفي النجاح والتميز على أداء السوق المالية و يعتبر من ابرز عوامل نموها، كما تبين أيضا أنه ومن خلال الهندسة المالية الإسلامية يمكن تطوير وابتكار أدوات مالية إسلامية من شأنها توسيع وتنشيط السوق المالية الإسلامية، التي تكمل وتساهم في تطوير العمل المصرفي من جهة، وتعمل على تدعيم النمو الاقتصادي في الدول الإسلامية من جهة أخرى. The Islamic financial market occupies an important and distinctive position in contemporary economic systems, and As it was found that the first and most important steps for establishing an Islamic financial market lie in the availability and presence of Islamic financial instruments that are regulated by Shari’a controls in issuance and circulation. Therefore, this study came to show the role and importance of Islamic financial instruments, especially among them compatible stocks, the provisions of Islamic Shari’a and Islamic instruments. And Islamic investment funds in activating and developing the Islamic financial market, as it shows that the success and development of this market depends on the diversity and development of the Islamic financial instruments traded in it, as the availability of more than one alternative for investors confers success and distinction on the performance of the financial market. One of the most prominent factors of its growth, as it was also found that through Islamic financial engineering it is possible to develop and innovate Islamic financial tools that would expand and revitalize the Islamic financial market, which complement and contribute to the development of banking work on the one hand, and work to support economic growth in countries Islam on the other hand.
