الأحكام الموضوعية لمسؤولية الناقل في عقد النقل البري للبضائع

Résumé: لقد تدخل المشرع وقام بتنظيم عقد النقل البري للبضائع ورتب التزامات على عاتق الناقل ، والتي إذا أخل بها ترتبت في ذمته المسؤولية. ونظرا لأهمية هذا العقد في الحياة الاقتصادية فقد نظم هاته المسؤولية بأحكام خاصة تختلف عن القواعد العامة في المسؤولية العقدية بحيث أن عبء الاثبات فيها يقع على عاتق الناقل رغم أنه مدعى عليه, كما أنه ضيق من مجال الاعفاء منها. The legislator intervened and organized the land transport contract for goods and arranged obligations for the carrier, which if he breached them would result in his responsibility. Given the importance of this contract in the economic life, it has organized this responsibility with special provisions that differ from the general rules in contractual liability so that the burden of proof in it falls on the carrier even though he is a defendant, and it is also narrow in the scope of exemption from it.
