دور الدليل الرقمي في اثبات الجريمة المعلوماتية في القانون الجزائري

Résumé: تهدف هذه الدراسة إلى تحديد الإطار المفاهيمي للدليل الرقمي ، من خلال الوقوف على مفهوم الدليل الإلكتروني كوسيلة إثبات في الجريمة المعلوماتية ، و تحديد مفهومه وخصائصه التي يتميز بها عن باقي الأدلة الجنائية التقليدية ، بالإضافة إلى تبيين أنواع الدليل الرقمي. وقد حاولت التطرق إلى القيمة الثبوتية للدليل الرقمي من خلال توضيح إجراءات استخلاص الدليل الرقمي والصعوبات التي تواجه استخلاص هذا الدليل ، وفي الأخير تناولت حجية الدليل الرقمي في الإثبات من خلال معرفة معنى الإثبات الجنائي والمبادئ التي يقوم عليها ، كذلك سلطة القاضي الجنائي من حيث تقدير الدليل الرقمي وقبوله أمام القضاء الجزائي. الكلمات المفتاحية: الدليل الرقمي، الإثبات، تقدير. Summary : This study aims to define the conceptual framework of the digital evidence by identifying the nature of the electronic evidence as a means of proof in in the information crime, and to determine its concept and characteriistics that distinguish it from the rest of the traditional forensic evidence, in addition to clarifying the types of digital evidence. I have tried to address the probative value of digital evidence by clarifying procedures for extracting digital evidence and the difficulties encountered in extracting this evidence, Finally, i dealt with the authenticity of digital evidence in proof by knowing the meaning of proof and the principles on which it is based,as well as the authority of the criminal judge in terms of estimating and accepting digital evidence before the criminal court.
