التَّكْيِيفُ الفِقْهِيُّ وَالقَانُونِيُّ لِتَعَاطِي المُخَدِّرَاتِ وَالاتِّجَارِ بِهَا

Résumé: يدرس هذا البحث آفة المخدرات من منظور فقهي وقانوني، وهو موسوم بالعنوان الآتي: "التكييف الفقهي والقانوني لتعاطي المخدرات والاتجار بها"، وتهدفُ هذه الدراسة إلى بيان عظيم خطر المخدرات وخطر انتشارها، وتهدف أيضا إلى بيان الحكم الشرعي فيها، والعقوبات الفقهية والقانونية المقررة لها زجرا لمتعاطيها، وقد جاءت مقسمة في ثلاثة أقسام، الأول تناول تعريف المخدرات وأنواعها، والثاني بين الحكم الشرعي لتعاطي المخدرات والاتجار بها وعقوبتها، والثالث فيه الجهود القانونية الدولية والوطنية في مكافحة المخدرات، ومن أهم نتائج هذه الدراسة أن المخدرات لها أخطار جسيمة على العقل والجسم، وعلى الفرد والمجتمع، لذلك فإن تعاطيها وترويجها وبيعها وزراعتها وتسويقها محظورٌ ويُعاقِبُ عليه الفقه والقانون. This research studies the scourge of drugs from a jurisprudential and legal perspective. and is marked with the following title: "Juristic and legal conditioning for drug use and trafficking". This study aims to explain the great danger of drugs and the danger of their spread, it also aims to explain the Sharia ruling on them, and the jurisprudential and legal penalties prescribed for them. It is divided into three sections, the first deals with the definition of drugs and their types. The second between the Sharia ruling on drug abuse and trafficking and its punishment. and the third is the international and national legal efforts in drug control. and one of the most important results of this study is that drugs have grave dangers to the mind and body, the individual and society, therefore, its abuse, promotion, sale, cultivation and marketing is prohibited and punishable by jurisprudence and law.
