الآليات القانونية لحماية الحق في الصحة في ضوء أحكام القانون رقم 18-11 المعدل والمتمم

Résumé: ملخص: يعتبر الحق في الصحة من الحقوق الأساسية للإنسان والمواطن، المكرس بموجب المواثيق الدولية والتشريعات الوطنية، باعتباره جزءا جوهريا في منظومة حقوق الانسان، يرتبط هذا الحق ارتباطا وثيقا بحقوق أساسية أخرى مثل الحق في الحياة والحق في التغذية السليمة...إلخ، مما يفرض على الدولة التزاما قانونيا باتخاذ كافة التدابير الوقائية اللازمة لحماية الصحة العامة، ومكافحة عوامل الخطر، وتعزيز أنماط الحياة الصحية لضمان تحقيق الرفاهية العامة. تهدف هذه الدراسة الى تحديد مفهوم الحق في الصحة وأساسه القانوني، مع تحليل الآليات القانونية المؤسساتية والوقائية التي تكفل حماية هذا الحق وفقًا لأحكام القانون رقم 18-11 المتعلق بحماية الصحة وترقيتها، المعدل والمتمم. Abstract: The right to health is considered one of the fundamental rights of the individual and citizen, enshrined in international covenants and national legislation, as an essential part of the human rights system. This right is closely linked to other fundamental rights such as the right to life and the right to adequate nutrition, etc. This imposes a legal obligation on the state to take all necessary preventive measures to protect public health, combat risk factors, and promote healthy lifestyles to ensure the achievement of public welfare. This study aims to define the concept of the right to health and its legal foundation, along with analyzing the legal, institutional, and preventive mechanisms that guarantee the protection of this right according to the provisions of Law No. 18-11 related to the protection and promotion of health, as amended and supplemented.
