تلازم الاختصاصين القضائي والقانوني في المنازعات الدولية الخاصة

Résumé: يعالج هذا البحث مسألة التلازم بين الاختصاصين القضائي والقانوني التي تعرفها بعض منازعات القانون الدولي الخاص، كاستثناء من مبدأ عدم التلازم الذي استوجبته اعتبارات التعايش بين القوانين والسماح بتطبيق القوانين الأجنبية أمام المحاكم الوطنية، فتم التطرق لمظهرين رئيسيين منه؛ أولهما جلب الاختصاص القضائي للاختصاص القانوني وثانيهما جلب الاختصاص القانوني للاختصاص القضائي، مع تفرعاتهما، وما يوجبهما من مبررات، وذلك بمنهجية تحليلية؛ لنخلص في نهاية البحث إلى أهمية هذا التلازم ودوره في تحقيق مجموعة من الغايات، من قبيل احترام السيادة والنظام العام وتحري العدالة والفعالية في حل النزاع، على أن يبقى مجرد استثناء رهين بتحقيق هذه الغايات، ويبقى المبدأ السائد هو استقلالية الاختصاصين عن بعضهما البعض. This research is about the correlation of and applicable law, concerning some Private International disputes as an exception of non-correlation principle imposed by considerations of coexistence between laws, and the possibility of the application of foreign laws in national courts. So, we studied two main aspects of this correlation, with their branches, and their justifications, through an analytical method. And by the end of this research we concluded that this correlation plays an important roles in the respect of sovereignty, the public policy, and achieving justice and effectiveness in resolving disputes, but as an exception to the non-correlation principle which remains dominant.
