الحماية التكنولوجية لحق المؤلف والحقوق المجاورة

Résumé: تهدف هذه الورقة البحثية إلى تبيان أثر البيئة الرقمية على حقوق الملكية الفكرية، على اعتبار أن الطبيعة اللامركزية للإنترنت تتيح لأي مستخدم نشر أي مصنف عمل بصورة غير محدودة في الفضاء الإلكتروني من خلال عدد من المنافذ، مما يؤدي إلى القرصنة العالمية، الأمر الذي يمس بالمصلحة الخاصة بحق المؤلف وحقوق المجاورة ،وتضمن البحث أهم آليات الحماية التكنولوجية لحق المؤلف والحقوق المجاورة. توصلت الدراسة الى ضرورة تفعيل التدابير التكنولوجية المتعلقة بحماية حق المؤلف والحقوق المجاورة من جهة، وتحقيق التوازن بين المصلحة الخاصة لحق المؤلف والحقوق المجاورة والمصلحة العامة.
