حكم الفتوى في النوازل الفقهية ومنهجها

Résumé: يهدف البحث إلى إبراز مفهوم الفتوى في النوازل الفقهية وحكمها والمنهج المتبع عند الفتوى فيها.وتأتي أهمية الدراسة في إعطاء النوازل الفقهية المستجدة أحكامها الشرعية المناسبة، وإحياء ما اندرس من معالم الدين. وقد خلصت الدراسة إلي أن أهمية فقه النوازل تكمن في سد حاجة الأمة، وأن المفتى في نازلة من النوازل للتوصل إلي حكمها، عليه أن يسلك منهج هو التصور، ثم التكييف، ثم الاستنباط، ثم التطبيق. The research aims to highlight the concept of fatwa in jurisprudential jurisprudence and its ruling and the approach followed by the fatwa. The importance of the study comes in giving the jurisprudential jurisprudence of the new jurisprudence of the appropriate, and reviving what is enshrined in the features of religion.
