ظاهرة العولمة و القانون الدولي العام: التداعيات والانعكاسات

Résumé: النظام الدولي المعاصر اعتمد مجموعة هائلة من الأدوات التي من شأنها فرض المزيد من الهيمنة، هاته الأدوات تفرعت إلى ما هو دبلوماسي (قوة ناعمة) و ما هو عسكري تحكمه مبادئ القوة العسكرية، و هذا كله على مستوى تنظيم العلاقات فيما بين الوحدات الدولية و على اختلاف طبيعتها، لكن و بالرجوع إلى البيئة الداخلية لنظم هاته الوحدات نلمس جيدا مدى الاهتمام بجل الاقترابات القانونية المؤسساتية و الاعتماد عليها بشكل كبير، و التي من شأنها تنظيم العلاقات و التفاعلات الحاصلة داخل تلك المجتمعات، إلا أن التحولات الدولية الراهنة أثرت على هاته الاقترابات -بشكل عام- خصوصا و أن العولمة لعبت دورا كبيرا في التأثير على ما هو محلي و ما هو دولي، لذلك سنحاول التركيز على بحث نقطة جد مهمة من خلال مقالنا هذا تتركز حول معرفة طبيعة التأثير الذي أفرزته العولمة على القانون الدولي.
