النظام القانوني للمنظمات المهنية
Résumé: تعتبر المنظمات المهنية هيئات إدارية تشرف وتسير ،نشاطات مهنية معينة والتي كانت تدخل ضمن المهام التي تقوم بها الدولة لتترك هذه الأخيرة مسؤولية تسير هذه النشاطات للأعضاء المنخرطين تحت لواء هذه المنظمات وذلك لمعرفتها ان هذه المنظمات هي الاقدر والانسب على ذلك لما تحوزه من خبرة وكفاءة بشؤون القطاعات وبالتالي خولت لها بعض امتيازات السلطة العامة بواسطتها تقوم بتأدية مهامها وتحقيق مصالحها ومصالح أعضاءها ، وبالتالي أصبحت هذه المنظمات تقوم بدور المنظم للمهنة ومثالها (منظمة المحامين )،وذلك عن طريق اصدار قرارات إدارية تتسم بالطابع الإداري هذا ولقد اعترف المشرع للمنظمات المهنية بالشخصية المعنوية والاستقلال المالي والإداري ومنحها أيضا حق التقاضي امام الجهات القضائية المختصة ، مما جعلها تتميز وتختلف عن بعض التنظيمات المشابهة لها كالنقابات العمالية وكذا الجمعيات . وتخضع نشاطات المنظمات المهنية للرقابة الإدارية وكذا الرقابة القضائية abstract : Professional organizations are considered as administrative bodies that oversee and conduct certain professional activities, which were part of the State's tasks, the latter is consequently responsible for the activities of the members under the banner of these organizations knowing that these organizations are the most capable and appropriate for this thanks to their experience and efficiency regarding the affairs of the sectors and thus given some of the privileges of public authority by which it performs its functions and achieve its interests and the interests of its members , therefore, it have become the organizers of the profession and the like (Lawyers Organization), through the issuance of administrative decisions of administrative nature as well as the legislator has recognized moral personality and financial and administrative independence to the professional organizations and also granted it the right of litigation before the competent judicial authorities, which made them distinct and different from some similar organizations such as syndicates and associations The activities of professional organizations are subject to administrative control as well as judicial oversight.
