تداول الأسهم وعلاقته بالاعتبارين المالي والشخصي في شركة المساهمة

Résumé: يعد حق المساهم في تداول أسهمه أهم مظاهر الاعتبار المالي في شركة المساهمة، غير أن ذلك لا يعني انعدام مظاهر الاعتبار الشخصي خلال القيام بعملية التداول، على أساس أن صوره تتجسد بشكل واضح في الحالة التي يتم فيها تقييد حق المساهم في تداول أسهمه سواء بقيود قانونية أو بقيود اتفاقية، وعليه يمكن القول أن الاعتبار الشخصي يأخذ حيزا خلال تداول الأسهم، على الرغم من أن شركة المساهمة وجدت بالدرجة الأولى لأجل إنجاز مشاريع في ظل علاقات مالية وليس علاقات شخصية. The shareholder’s right to trade his shares is considered the most important aspect of financial consideration in a joint stock company, but this does not mean the absence of any manifestations of personal consideration during the trading process, on the basis that its images are clearly embodied in the case in which the shareholder’s right to trade his shares is restricted, whether whith legal restrictions or agreement restrictions and accordingly it can be said that personal consideration takes place during the trading of shares, even though the joint-stock company was created primarily for the purpose of carrying out projects in the context of financial relationships and not personal relationships.
