Résumé: ملخص: تحظى الأصناف النباتية الجديدة باعتبارها أحد أشكال الملكية الفكرية بالحماية القانونية متى استوفت الشروط الموضوعية والشكلية للحصول على شهادة الحيازة النباتية، والتي تعتبر سند يحمي به صاحب الحق الصنف النباتي الجديد من أي اعتداء، فمسألة تنظيم الحماية القانونية هي من المواضيع المستحدثة والتي نظمها المشرع الجزائري بموجب القانون 05-03 المتعلق بالبذور والشتائل و حماية الحيازة النباتية، حيث نص على مجموعة من الأحكام و العقوبات ضد كل إعتداء عن طريق ما يسمى بالقرصنة البيولوجية، كما تهدف دراسة الجوانب القانونية للحماية في ابراز أهمية الأصناف النباتية الجديدة في تحقيق الأمن الغذائي والتنمية المستديمة، و كذا توضيح الدور المؤسساتي للجنة الوطنية للبذور والشتائل والتي تتمتع بالعديد من الصلاحيات من أجل تكريس الحماية في إطار التدابير والإجراءات التي تقوم بها في إطار ما يمليه القانون . Abstract: New plant varieties, as a form of intellectualproperty, enjoy legal protection when they meetthe objective and formal conditions forobtaining a plant possession certificate, whichis a document by which the right holderprotects the new plant variety from anyaggression. According to Law 05-03 relatedto seeds and seedlings and the protectionof plant tenure, which stipulates a setof provisions and penalties against every attackthrough the so-called biopiracy, and thestudy of the legal aspects of protectionaims to highlight the importance ofnew plant varieties in achieving food securityand sustainable development, As well asclarifying the institutional role of the NationalCommittee for Seeds and Seedlings, which hasmany powers in order to establishprotectionwithin the framework of the measures andprocedures it undertakes within the framework ofwhat is dictated by law.
