الأوامر الولائية لقاضي شؤون الأسرة الجزائري

Résumé: لقد فرق المشرع الجزائري في تقنين الإجراءات المدنية و الإدارية و في قانون الأسرة, بين الخصومة القضائية التي تبتدأ بالدعوى و تنتهي بصدور الحكم الفاصل في موضوع الدعوى, وبين التدابير التي تكون الغرض منها الحفاظ على الحق,تصدر أثناء الخصومة أو بدونها عبارة عن قرارات تحفظية أو وقتية, يهدف من خلالها أصحابها إلى المحافظة على الحق أو تأكيده, و قد منح المشرع الجزائري هذه السلطة لقاضي الموضوع بعدما كان الإختصاص يؤول إلى رئيس المحكمة, و سلطة قاضي الموضوع في هذا الشأن منها ماهوما نص عليه في قانون الإجراءات المدنية و الإدارية و قانون الأسرة, و سلطة القاضي في إصدار هذه الأوامر هي ولايته العامة و ذلك في تطبيقه هذه الأوامر, لا تدخل ضمن عمل القاضي في وظيفته العادية.
