مانع اتفاق الجنس في الزواج بين الفقه الإسلامي والاتفاقيات الدولية

Résumé: من أركان الزواج المحل وهو الزوج والزوجة ويشترط فيهما أن يكونا مختلفين في الجنس، وقد نصت على ذلك الرسالات السماوية بما فيها الإسلام، واعتبرت خلافها من كبائر المعاصي والرذائل، غير أنه في الآونة الأخيرة نادت بعض الاتفاقيات الدولية بإباحة زواج المثليين والمتحولين جنسيا، وهذا خلافا للفطرة التي خلق عليها الإنسان، ولذلك جاءت هذه الدراسة للإجابة على الإشكالية التالية: ما حقيقة اختلاف الجنس بين الزوجين في الزواج في الشريعة الإسلامية والاتفاقيات الدولية؟ وقد تم التطرق إلى حكم اختلاف الجنس في الزواج في الفقه الإسلامي والاتفاقيات الدولية، ومعرفة مدى خطورة ما نصت عليه هذه الأخيرة في هذا الباب، ومن النتائج المتوصل إليها في هذا البحث أن جراحة تحويل الجنس محرمة شرعا إذا كانت لدواع نفسية فقط وليس لخلل عضوي في الأعضاء التناسلية, وأما إذا كانت لأسباب مرضية فإنها تكون مشروعة ومباحة، ومن ضمن التوصيات المتوصل إليها إيجاد آلية لمقاومة الاجتياح الإعلامي, والضغط الدولي الموجه لتشريع المثلية, ونشرها في العالم الإسلامي بما يحقق التصدي لها وحماية الأمة من شرورها. Abstract: One of the pillars of valid marriage is the husband and wife, and they are required to be of different sexes. This has been stipulated in the divine messages, including Islam, and otherwise is considered a major sin and vice. However, recently some international agreements have called for the permissibility of same-sex and transgender marriage, and this is contrary to nature. With which man was created, and therefore this study came to answer the following problem: What is the truth about the difference in sex between spouses in marriage in Islamic law and international agreements? The ruling on gender differences in marriage has been discussed in Islamic jurisprudence and international agreements, and the extent of the seriousness of what the latter stipulates in this section has been known. Among the results reached in this research is that sex reassignment surgery is forbidden by Islamic law if it is for psychological reasons only and not for an organic defect in the reproductive organs. However, if it is for pathological reasons, then it is legitimate and permissible. Among the recommendations reached is finding a mechanism to resist the media invasion and the international pressure directed at it. To legalize homosexuality and spread it in the Islamic world in a way that confronts it and protects the nation from its evils.
