الحماية القانونية للمعطيات الشخصية للطفل في الفضاء الرقمي

Résumé: إن موضوع حماية الطفل في الفضاء الرقمي من المواضيع الشائكة التي كرست لها معظم الدول عديد الآليات القانونية لحماية هذه الفئة الحساسة من المخاطر التي يكونون عرضةً في هذا المجال، ولعلّ أهمها على الإطلاق إنتهاك معطياتهم الشخصية وما تنطوي عليه من إنتهاكات لخصوصياتهم الرقمية. وفي هذا الصدد حاول المشرع الجزائري أن يحمي الطفل من تعرضه لمثل تلك الإنتهاكات أو حتى إنتهاكات أخرى، حيث أنه قام بإستحداث العديد من النصوص القانونية في هذا المجال والتي يبقى القانون رقم 18-07 المتعلق بحماية الأشخاص الطبيعيين في مجال المعطيات ذات الطابع الشخصي أهمها، حيث يأتي هذا المقال سعيًا منا لتبيان مدى توفير الحماية الضرورية للطفل في ظل عالم الرقمنة في إطار هذا القانون. الكلمات المفتاحية: طفل، حماية، تكنولوجيا، معطيات شخصية، رقمنة. Abstract: The issue of child protection in the digital space is one of the thorny issues to which most countries have devoted many legal mechanisms to protect this sensitive group from the risks they are exposed to in this field, and perhaps the most important of all is the violation of their personal data and the violations of their digital privacy. In this regard, the Algerian legislator tried to protect the child from being exposed to such violations and thus enacted Law No. 18-07 relating to the protection of natural persons in the field of data of a personal nature. This article comes in an effort to show the extent to which the necessary protection is provided to the child in light of the digitization world in framework of this law.
