آليات تأطير الاستثمار الفلاحي المستدام بالأراضي الصحراوية في التشريع الجزائري

Résumé: الملخص : تعالج هذه الدراسة موضوع الاستثمار الفلاحي المستدام عن طريق الإستصلاح في المحيطات الإستصلاحية ، حيث بادرت الدولة الجزائرية بابتكار آليات قانونية وأخرى مؤسساتية ، من أجل التسيير الأمثل للقطاع الفلاحي ، وهذا بمنح الأراضي الفلاحية بالمناطق الصحراوية للاستثمار والاستصلاح من أجل التملك وفق القانون 83/18 أو عن طريق الإمتياز وفق المرسوم التنفيذي 21/432، كما تم استحداث ديوان تنمية الزراعة الصناعية وفق المرسوم التنفيذي 265.20 لتطوير زراعة المحاصيل الإستراتيجية ، وتوفير العقار الفلاحي ، و تقديم التسهيلات اللازمة للمستثمرين الفلاحيين الحاملين للمشاريع التنموية ، مع مراقبة سير الاستثمار وفق البرنامج المسطر، والهدف من هذا البحث هو بيان مدى قدرة المنظومة القانونية الجزائرية في تحقيق الأمن الغذائي والأمن الاقتصادي في إطار التنمية الفلاحية المستدامة ، وباعتبار أن مشروع الاستصلاح والاستثمار في المحيطات الاستصلاحية هو مشروع يمس باقتصاد الدولة ، فمن الواضح إن هناك فرق شاسع بين رهانات الدولة والواقع والذي يحتاج إلى الكثيرمن التدقيق التشريعي والوظيفي . This study addresses the topic of sustainable agricultural investment through land reclamation reformism. The Algerian government has taken steps to establish legal and institutional mechanisms for the effective management of the agricultural sector. This involves granting agricultural land in desert regions for investment and reclamation with the aim of ownership in accordance with Law 18/83 or through concessions as per Executive Decree 432/21; additionally, the establishment of the Office for the Development of Industrial Agriculture through Executive Decree 20.265 aims to enhance the cultivation of strategic crops, provide agricultural real estate, and offer the necessary facilities for agricultural investors carrying out development projects, while monitoring the progress of investment according to the outlined program, The aim of this research is to demonstrate the ability of Algeria's legal system to achieve food and economic security within the framework of sustainable peasant development. Given that the restoration and investment project in reclamation oceans is a project that affects the State economy, it is clear that there is a wide difference between State bets and reality, which requires much legislative and functional scrutiny.
