خصوصية العقد الإلكتروني

Résumé: :الملخص يُعتبر العقد الإلكتروني من أهم ما اِستُحدِثَ في عالم التّجارة الإلكترونيّة، لطبيعة البيئة الافتراضية التي يُبرم من خلالها. وهذا ما يدعونا إلى تعريفه من خلال بيان أوجه الخصوصيّة فيه، كونه عقد يبرم عن بعد. وأمام أهمية هذا العقد في التعاملات التجارية الوطنية والدولية، واهتمام الدول في تنظيمه، نجد المشرع الجزائري وعلى غرار باقي التشريعات، قد قام بتعديل القانون المدني سنة 2005، حيث اعترف بالحجية القانونية للإثبات بالطرق الإلكترونية، كما أصدر القانون رقم 15-04 الذي يحدد القواعد المتعلقة بالتوقيع والتصديق الإلكتروني، وكذا القانون 18-05 الخاص بالتجارة الإلكترونية، واضعا أحكاما جديدة بغرض إعادة تنظيم كل ما يتعلق بها و بيان الأحكام العامة لهذا العقد،على غرار ما تَنَاولتهُ مختلف التشريعات المقارنة في هذا الصّدد. الكلمات المفتاحية:العقد الإلكتروني– التجارة الإلكترونية– الإنترنت–وسائل الاتصال الحديثة – المعاملات الإلكترونية. Abstract: The electronic is considered one of the most important developments in the world of electronic commerce.due to the nature of the virtual environment through wich is is concluded .this calls us to define it bye showing the aspects of privacy in it, as it is a contract concluded from a distance.faced with the importance of this contract in national and international commercial dealings, and the interst of states in its regulation, we find the Algerian legislator, like other legislation,amended the civil code in 2005,recognizing the lega validityof electronic evidence,and issued law No.15-04 defining the rules relating to by electronic signature and ratification, as well as Law 18-05 on e-commerce, they put in place new provisions of this contract,similar to what has been dealt with bye various comparative legislation in this regard.
