أثر الجرائم البيئية الفرنسية على النظام البيئي الجزائري --التجارب والأسلحة النووية نموذجًا-

Résumé: تقدم هذه الورقة تأريخا للجرائم البيئية الفرنسية في الصحراء الجزائرية نتيجة التجارب النووية التي قامت بها في الجزائر بداية من سنة 1960 إلى غاية 1965، وتحليلا قانونيا لأثر تلك التجارب النووية، أين تعدت فيها أثار تجربة رقان النووية وحدها ثلاثة أضعاف القنبلة الذرية بهيروشيما، وما استتبع ذلك من دمار للنظام البيئي الجزائري وعناصره الحية وأثر ذلك بشكل سلبي على حياة وصحة الجزائريين باعتبارهم صاحب الحق الأصيل في بيئة صحية ملائمة طبقا للمواثيق الدولية والقوانين الوطنية، و قد ترتب عن الأضرار البيئية المباشرة و غير المباشرة التي تسببت فيها مختلف التجارب االنووية اقامة المسؤولية البيئية الدولية عن الجرائم البيئية لفرنسا و ضرورة التعويض حسب ما نصت عليه المواشيق الدولية و القوانين الوطنية.. This paper presents a history of the French environmental crimes in the Algerian desert as a result of the nuclear tests it carried out in Algeria from 1960 to 1965, and a legal analysis of the impact of those nuclear tests, where the effects of the Reggane nuclear test alone exceeded three times the atomic bomb in Hiroshima, and what followed that From the destruction of the Algerian ecosystem and its living elements and its impact on the life and health of the Algerian human being, as he is the holder of the inherent right to an appropriate healthy environment in accordance with international charters and national laws ; The direct and indirect environmental damage caused by the various nuclear tests has resulted in the establishment of international environmental responsibility for France’s environmental crimes and the necessity of compensation as stipulated by various international charters and national laws
