دور النيابة العامة في القضايا المتعلقة بالأسرة

Résumé: ملخــــص : لقد خول المشرع الجزائري للنيابة العامة الحق في التدخل كطرف أصلي في جميع القضايا المتعلقة بشؤون الأسرة، بصريح نص المادة 03 مكرر من قانون الأسرة، وقد أثار تطبيق نص المادة عدة إشكالات وغموض من الناحية العملية، إلى حين صدور قانون رقم 08/09 المتعلق بقانون الإجراءات المدنية والإدارية المؤرخ في 25 فبراير 2008 الذي حاول من خلاله المشرع إزالة الغموض حول هذه المسألة،بأن حدد تدخل النيابة العامة بكل دقة في القضايا المدنية بصفة عامة، وفي القضايا المتعلقة بشؤون الأسرة بصفة خاصة، وفقا لنص المادة 256 التي خولت للنيابة العامة الحق في الإدعاء كطرف أصلي أو التدخل كطرف منضم. Abstract : Algerian legislator has authorized to the public prosecutor the right to intervene as a party in the all original issues relating to famili affairs, as explicitly shown in the texte of article 03 bis of the Family Law.
