معيقات تطوير الصيرفة الإسلامية في الجزائر وآليات مواجهتها

Résumé: يهدف هذا المقال إلى البحث عن آليات مواجهة المعيقات التي تحول دون تطوير الصيرفة الإسلامية في الجزائر، ففي الوقت الذي تسعى فيه العديد من المؤسسات الإسلامية إلى تقديم الاستشارات والدعم اللازم لتطوير الصناعة المصرفية الإسلامية، نجد أن الجزائر بعيدة عن الاهتمام بتطوير هذه الصناعة، حيث تشهد المصرفية الإسلامية في الجزائر العديد من المعيقات التشريعية والتنظيمية كالقوانين والأنظمة المصدرة من بنك الجزائر لإدارة النظام المصرفي لاسيما قانون النقد والقرض على غرار الأمر03-11 والأوامر المعدلة والمتممة له، لتمكين المصارف الإسلامية من تطوير منتجاتها وتقديم خدمات مبتكرة، لذا يجب اعادة النظر في التشريعات الحالية وتعديلها وفق مبادئ الشريعة الإسلامية على غرار النظام18-02 المتضمن قواعد ممارسة العمليات المصرفية المتعلقة بالصيرفة التشاركية من طرف المصارف والمؤسسات المالية. Abstract The aim of this article is to find how to face obstacles to the development of Islamic banking in Algeria. While many Islamic institutions seek to provide advice and support for the development of the Islamic banking industry, Algeria is far from interested in developing this industry, Where Islamic banking in Algeria is witnessing many legislative and regulatory obstacles such as the laws and regulations issued by the Bank of Algeria to manage the banking system, especially the Money and Loan Law, as in the case of Order No. 3-11 and the amended and complementary orders, to enable Islamic banks to develop products And the provision of innovative services, so you must re-consider the current legislation and adjusted in accordance with the principles of Islamic law along the lines of 18-02 regulation containing the rules of the practice of banking operations related to participatory banks, financial institutions.
