نفي النسب بين النصوص الشرعية و التطبيقات العلمية -دراسة تحليلية في الفقه الإسلامي والتشريع والقضاء الجزائري –

Résumé: نص المشرع الجزائري في المادة 40/2 قانون الأسرة الجزائري على أنّه يجوز للقاضي اللجوء إلى الطرق العلمية لإثبات النّسب ، و نص في المادة 41 من نفس القانون أنّه ينسب الولد لأبيه متى كان الزواج شرعيا و أمكن الاتصال و لم ينفه بالطرق المشروعة . و الملاحظ من هذين النّصين أنّ المشرع الجزائري تبنى تقنية البصمة الوراثية كوسيلة لإثبات النّسب إلا أنّه لم يحدد إن كان ينفى بها النّسب أم لا ، كما أنّ عبارة "ما لم ينفه بالطرق المشروعة " جاءت بلفظ عام و شامل ،و بهذا يمكن إدخال طرق أخرى غير اللعان في نفي النّسب بما فيها البصمة الوراثية ،و هذا ما أثار جدلا فقهيا و قانونيا و قضائيا واسعا في هذا الشأن . Abstract : The Algerian legislator stipulates in article 40/2 of the Algerian Family Code that the judge may resort to scientific methods to prove descent, and in article 41 of the same law stipulates that he attributes the child to his father when the marriage is legitimate and the communication is possible and he does not deny it by legitimate means . It is noticeable from these two texts that the Algerian legislator adopted the technique of DNA as a means of proving descent, but did not specify whether he denies it descent or not, and the phrase "unless it is denied by legitimate means" came in a general and comprehensive term, and thus can introduce methods other than damn in the denial of descent, including the genetic fingerprint, and this has provoked a wide jurisprudence, legal and judicial debate in this regard.
