أخلاقيات البحث العلمي وآليات المحافظة عليها في القانون الجزائري

Résumé: الملخص: يتناول هذا المقال دراسة التنظيم القانون لأخلاقيات البحث العلمي في الجزائر، وهو موضوع هام جدا، لأنه لا يمكن الرقي بالبحث العلمي، وتحقيق جودته إلا إذا التزم المشتغلون بهذا المجال بأخلاقيات البحث العلمي، ولأن هذا الالتزام بدأ يضعف مؤخرا، بحيث انتشرت الانحرافات الأخلاقية، فقد كان من الضروري تدخل المشرع لتنظيم هذا الموضوع، من أجل تعزيز أخلاقيات البحث العلمي، وفرض احترامها، ومحاربة مختلف أشكال الانحراف عنها، وخاصة السرقة العلمية. وفي هذا الإطار نص القانون الجزائري على إنشاء عدّة هيئات تُعنى بهذا الموضوع، واعتمد مدونات ومواثيق لهذه الأخلاقيات، كما جرّم السرقة العلمية واتخذ كافة الإجراءات للوقاية منها ومكافحتها. Abstract: This article deals with the study of the legal regulation of the ethics of scientific research in Algeria, which is a very important topic, because it is not possible to advance scientific research and achieve its quality unless those working in this field adhere to the ethics of scientific research, because this commitment began to weaken recently, so that ethical deviations spread, it was necessary for the legislator to intervene to regulate this subject, in order to promote the ethics of scientific research, to enforce respect for it, and to combat all forms of deviation from it, especially scientific theft. In this context, the Algerian law stipulated the establishment of several bodies concerned with this subject, and adopted codes and charters for these ethics. It also criminalized scientific plagiarism and took all measures to prevent and combat it.
