مشاركة المواطن كآلية لتفعيل الديمقراطية التشاركية على مستوى البلدية بين التكريس القانوني وإشكالات التطبيق

Résumé: الملخص: تهدف هذه الدراسة إلى تسليط الضوء على موضوع إشراك المواطن كأساس للديمقراطية التشاركية، باعتبارها أحد مؤشرات الحكم الراشد، وأهم دعائم التنمية المستدامة، وذلك للوقوف على كيفية ضمان مشاركته في صنع و تنفيذ القرارات بشكل يستجيب لتطلعاته، وايجاد حلول للإشكالات التي تعترض طريقه لبلوغ ذلك المسعى. وفي سبيل ذلك حرص المؤسس الدستوري الجزائري خاصة لسنة 2016 على تكريس الديمقراطية التشاركية وتفعيل مساهمته في تسيير الشؤون المحلية إلى جانب السلطات المحلية، وذلك لتجاوز سلبيات الديمقراطية التمثيلية، والنهوض بدور المواطن في مجال التنمية. كما تم تجسيدها في النصوص التشريعية والتنظيمية قبل ذلك خاصة قانون البلدية لسنة 2011، الذي تبنى المقاربة التشاركية متضمنا الآليات التي تمكنه من مشاركة المجلس الشعبي البلدي في تسيير شؤون البلدية. وعلى الرغم من كل الجهود المبذولة تبقى هذه الآليات قاصرة كونها تتسم بعدم الإلزامية، الفعلية والمحدودية، لهذا ينبغي مواصلة الإصلاحات التي بادرت بها الدولة بكفالة ضمانات أكبر ترقى إلى متطلباته، تجسد وتعزز دوره وتشركه بصفة فعالة في تسيير الشؤون العامة خاصة على المستوى المحلي . Abstract : This study aims to update and clarify the subject of citizen participation under participatory democracy considering that it is an indicator of good governance and a major pillar of sustainable development. We try to approach the various methods which are used to guarantee the citizen participation in decision’s making and execution so as to meet his expectations, and to find solutions to different problems that can hinder his path to reach his goal, as an example the Algerian legislator on the 2016 constitution who has taken care to concretize participative democracy and activate the citizen participation in the management of local affairs with the locale authorities in order overcome the disadvantages of representative democracy and to promulgate the citizen role in development. We will also study the legislative and regulatory texts in the municipality law of 2011 whish have adopted the participatory approach and the mechanism that will permit the participation of the popular assembly in the management of the municipality affairs. But despite all the efforts made we find that these mechanisms are insufficient because they are not compulsory and are limited, that is why it is necessary to continue the reforms undertaken by the government by offering greater guarantees that meet the requirements and strengthening the role of the citizen to permit an effective participation in the management of general affairs at the local level.
