مسؤولية الوسطاء في عمليات بورصة القيم المنقولة

Résumé: لا تكون بورصة القيم المنقولة قائمة بذاتها، بل تستند دعامتها من اشخاص خولهم القانون لمزاولة نشاط تداول الأوراق المالية ذلك بغية رفع من القيمة السوقية للبورصة، وإعطائها مكانة اقتصادية ومالية من بين بورصات الكبرى، حيث نظم المشرع الجزائري الاحكام التنظيمية للنشاط البورصة والأشخاص المؤهلين لذلك، هذا من خلال النظام 15-01 الذي نظم الضوابط المهنية للوسيط المالي من شروط اعتماده الى نظام مراقبته في عمليات البورصة. كما جاء المرسوم التشريعي رقم 93-10 المعدل والمتمم بموجب القانون رقم 03-04، والمتعلق ببورصة القيم المنقولة وما يخول للوسيط اجراءه في تلك القيم المنقولة، كما جاء بي الهيئة المكلفة بالحماية والمتمثلة في للجنة تنظيم عمليات البورصة ومراقبتها وأعطاها صلاحيات منح الاعتماد النهائي للمزاولة النشاط وعلاقتها بالوسيط المالي بالإضافة الى الضوابط الإدارية والمهنية للوسيط وجوب التقييد بها. مرورا بالممارسات الغير قانونية التي تمارس داخل بورصة القيم المنقولة ومن شأنها تحدث اضطرابا في القيمة والمركز الاقتصادي لها، سواء كانت أخطاء مرتكبة مرتبة التعويض، او القيام بجرائم ماسة بالمعلومة الاقتصادية للبورصة أو قيام بتحايلات بهدف التأثر في قيمة القيم المنقولة. The stock exchange is not self-contained، but its support is based on persons authorized by law to engage in the activity of securities trading in order to raise the market value of the stock exchange، and give it an economic and financial position among the major stock exchanges، as the Algerian legislator organized the regualatory provisions for the activity of the stock exchange and qualified persons Therefore، this is through the system 15-01، which regulates the professional controls of the financial intermediary from the conditions of its accreditation to its control system in the stock exchange operations. Legislative Decree No° 93-10 amended and supplemented by law No° 03-04، related to the Stock exchange and what the broker is authorized to do with those movable values، as stated by the body charged with protection، which is the committee for Organizing and Monitoring stock exchange operations and giving it the powers to grant final approval to practice the activity and its relationship with the financial intermediary، in addition to the professional control of the intermediary that must be adhered to. Passing through the illegal practices that are practiced within the stock exchange and may cause diruption in the value and economic status of it، whether they are mistakes committed in the rank of compensation، or committing crimes related to the economic information of the stock exchange، or performing frauds with the aim of affecting the value of the transferrd values.
